ToyTap Terms of Service: Serving You with Integrity, Just Like Our Toys

1. Scope of Services

• We operate an online retail store offering children’s toys, stress-relief toys, pet toys, and related products (collectively “Products”). All Products are sourced from verified, high-quality suppliers on Alibaba, with strict quality inspections to ensure compliance with international safety standards.
• We reserve the right to update, add, or discontinue Products at any time without prior notice, but we will always communicate material changes to affected customers.
• Our services include processing orders, arranging international shipping, providing customer support, and handling returns/exchanges in accordance with our published policies.

2. Eligibility & User Responsibilities

• You must be at least 18 years old to place an order with ToyTap. If you are purchasing on behalf of a minor (e.g., children’s toys), you confirm that you are a parent or legal guardian with the authority to do so.
• You agree to provide accurate, complete, and up-to-date information (e.g., shipping address, contact details, payment info) when placing an order. We are not liable for delays, non-delivery, or other issues caused by incorrect or outdated information.
• You are responsible for maintaining the confidentiality of your Shopify/PayPal account credentials (if applicable) and for all activities conducted under your account. Notify us immediately at toytap@toytaponline.com if you suspect unauthorized use of your account.

3. Orders & Payments

• When you place an order, you submit a binding offer to purchase the selected Products at the listed price. We reserve the right to accept or reject your order (e.g., if Products are out of stock, pricing errors occur, or we suspect fraudulent activity). You will receive an order confirmation email once your order is accepted and processed.
• Payment: Currently, we only accept PayPal for cross-border transactions, ensuring secure and compliant payments. We are actively adding more payment methods (e.g., Visa, Mastercard, Shopify Pay) and will notify customers via email/website announcements when available.
• Prices listed on our store are in USD (unless otherwise specified) and do not include customs duties, taxes, or import fees. These additional costs are the sole responsibility of the customer and are determined by your local customs authorities.
• We reserve the right to correct pricing errors at any time, even after an order is placed. If we discover a pricing error for your order, we will contact you to confirm whether you wish to proceed with the corrected price or cancel the order (with a full refund if payment has already been made).

4. Shipping & Delivery

• We ship to most countries/regions worldwide (see our FAQs for details). Delivery times vary by location and are estimated (not guaranteed) in our FAQs—we are not liable for reasonable delays caused by customs processing, logistics partners, or unforeseen circumstances (e.g., natural disasters).
• You will receive a shipping confirmation email with a tracking number once your order is dispatched. It is your responsibility to track your order and collect it from the designated delivery address. We are not liable for lost or stolen packages after delivery confirmation by the logistics provider.

5. Product Descriptions & Liability

• We strive to provide accurate, detailed descriptions (e.g., size, material, age recommendation, safety features) for all Products. • All children’s toys sold by ToyTap meet international safety standards (CE, CPSC, ASTM F963) and are made of non-toxic, eco-friendly materials. Pet toys are made of bite-resistant, non-toxic materials. We are not liable for personal injury, property damage, or other losses caused by:
  • Misuse, improper handling, or failure to follow product instructions (e.g., allowing children under 3 to use toys with small parts, unsupervised pet play with rope toys).
  • Normal wear and tear of Products (e.g., pet toys becoming worn after repeated use).
• Our liability for any defective Product is limited to replacing the Product or issuing a full refund (in accordance with our Return & Exchange Policy). We are not liable for indirect, incidental, or consequential damages (e.g., emotional distress, lost enjoyment) arising from the use or inability to use our Products.

6. Returns & Exchanges

• Our Return & Exchange Policy (available on our website) is incorporated into these Terms. By placing an order, you agree to comply with the conditions outlined in that policy (e.g., 30-day window, unused condition, exceptions for used pet toys).
• We reserve the right to refuse returns/exchanges that do not meet our policy requirements. Refunds will be processed to your original payment method within 5–7 business days of receiving and inspecting the returned Product.

7. Intellectual Property

• All content on our store (e.g., logo, brand name “ToyTap”, product images, descriptions, website design) is the exclusive intellectual property of ToyTap or our licensors. You may not copy, reproduce, distribute, modify, or use this content for commercial or non-commercial purposes without our prior written permission.
• Product trademarks, copyrights, or patents held by third-party manufacturers are the property of their respective owners. ToyTap is not affiliated with these third parties unless explicitly stated.

8. Termination

• We may terminate or suspend your access to our services at any time, without prior notice, if:

  • We suspect fraudulent activity, unauthorized account use, or misuse of our services.
• Upon termination, any pending orders (unshipped) will be canceled, and you will receive a full refund. Sections regarding intellectual property, liability limitations, and dispute resolution will survive termination.

If negotiation fails, the dispute shall be submitted to arbitration in Guangzhou, China, in accordance with the arbitration rules of the China International Economic and Trade Arbitration Commission (CIETAC).
